ON CLARIFICATION OF RIGHTS RELATED TO PERSONAL DATA PROCESSING

ON CLARIFICATION OF RIGHTS,

RELATED TO THE PROCESSING OF PERSONAL DATA

In accordance with part 2, paragraph 5, article 5, articles 10 — 15 of the Law of the Republic of Belarus from 07.05.2021 № 99-З “On personal data protection” and the General Data Protection Regulation (GDPR) of the European Union, we clarify that you as a subject of personal data have the right:

At any time without giving any reason to withdraw your consent to the processing of personal data by submitting to the LLC “MetaEra”, registered in the Unified State Register of Legal Entities and Individual Entrepreneurs with the registration number UNP: 193593635, with the address of location: Republic of Belarus, 220088, Minsk, Pulikhova St., 31/1-1n, room 14 (hereinafter — the Operator). 14 (hereinafter referred to as the Operator), application in writing or in the form of an electronic document, which must contain:

  • surname, first name, patronymic (if any), address of your place of residence (place of stay);
  • date of birth;
  • Your identification number, in the absence of such a number — number of your identification document;
  • statement of the essence of your requirements as a personal data subject;
  • Your personal signature or electronic digital signature.

The Operator is obliged within fifteen days after receiving your application in accordance with its content to stop processing of your personal data, to delete them and notify you about it, unless there are other grounds for such actions with personal data, provided by the Law of the Republic of Belarus from 07.05.2021 № 99-З “On Personal Data Protection” and other legislative acts.

In the absence of technical possibility to delete personal data, the Operator is obliged to take measures to prevent further processing of personal data, including their blocking, and notify you about it in the same period of time.

2. You have the right to receive information regarding the processing of your personal data containing:

  • Name (surname, first name, patronymic (if any)) and location (address of residence (place of stay)) of the Operator Operator;
  • confirmation of the fact of personal data processing by the Operator (authorized person);
  • Your personal data and the source of its receipt;
  • legal grounds and purposes of personal data processing;
  • the period for which the consent to the processing of personal data has been given;
  • name and location of the authorized person, which is a state authority, a legal entity of the Republic of Belarus, other organization, if the processing of personal data is entrusted to such a person;
  • other information stipulated by the legislation.

In order to receive this information, you must submit an application to the Operator. You do not have to justify your interest in the requested information.

Within five working days after receipt of your application, the Operator is obliged to provide you with the information in an accessible form or notify you of the reasons for refusal to provide it. Such information is provided to you free of charge, except for the cases stipulated by legislative acts.

  1. You have the right to request the Operator to amend your personal data in case the personal data is incomplete, outdated or inaccurate. For this purpose, you submit an application to the Operator attaching the relevant documents and (or) duly certified copies thereof, confirming the necessity to make changes to the personal data.

Within fifteen days after receipt of your application, the Operator is obliged to make appropriate changes to your personal data and notify you thereof or notify you of the reasons for refusal to make such changes, unless another procedure for making changes to personal data is established by legislative acts.

You have the right to receive information from the Operator about the provision of your personal data to third parties once a calendar year free of charge, unless otherwise provided by other legislative acts.

To obtain this information, you must submit an application to the Operator.

Within fifteen days after receiving your application, the Operator is obliged to provide you with information on what your personal data was provided and to whom it was provided during the year preceding the date of submission of the application, or notify you of the reasons for refusal to provide it.

The said information may not be provided if the processing of personal data is carried out in accordance with the legislation on enforcement proceedings, in the implementation of justice and organization of activities of courts of general jurisdiction.

  1. You have the right to demand from the Operator to stop processing of your personal data, including their deletion, free of charge, if there are no grounds for processing of personal data provided by legislative acts.

In order to exercise this right, you must submit an application to the Operator.

In this case, the Operator is obliged to stop processing of personal data within fifteen days after receiving your application, as well as to carry out their deletion (to ensure the termination of personal data processing, as well as their deletion by an authorized person) and to notify you about it.

If there is no technical possibility to delete personal data, the Operator shall take measures to prevent further processing of personal data, including their blocking, and notify you thereof within the same term.

The Operator has the right to refuse to satisfy your request to stop processing of your personal data and (or) to delete them if there are grounds for processing of personal data provided for by legislative acts, including if they are necessary for the stated purposes of their processing, with notification of this to you within fifteen days.

  1. You, as a subject of personal data, have the right to appeal the actions (inaction) and decisions of the Operator violating your rights in the processing of personal data to the authorized body for the protection of the rights of personal data subjects in the manner (National Center for Personal Data Protection of the Republic of Belarus) established by the legislation on appeals of citizens and legal entities.

The decision adopted by the authorized body for the protection of the rights of personal data subjects can be appealed by you in court in the manner prescribed by law.
